TERMS OF SERVICE

1. Agreement to Terms

By accessing our website (gurifreightpty.space) or engaging GURI Freight Pty Ltd (ABN 99 696 698 334, ACN 696 698 334) ("GURI Freight", "we", "us", "our") to provide freight, logistics, warehousing, or related services, you ("the Client", "you") agree to be bound by these Terms of Service. If you do not agree, you must not use our services or website.

2. Services

GURI Freight provides freight transportation, warehousing, logistics management, and express delivery services. The specific scope, pricing, and terms for each engagement will be set out in a quote, booking confirmation, or service agreement provided to you.

We reserve the right to subcontract any part of our services to qualified third-party providers. We remain responsible for the performance of subcontracted services to the extent set out in these Terms.

3. Quotes and Pricing

• All quotes are valid for 14 days from the date of issue unless otherwise stated.
• Prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise.
• Final pricing may vary if the actual weight, dimensions, or nature of goods differ from the information provided at the time of quoting.
• We reserve the right to adjust pricing due to fuel surcharges, tolls, or unforeseen circumstances.

4. Bookings and Cancellations

Bookings are confirmed upon written acceptance (including email) of a quote or service agreement. Cancellations must be made in writing:

• Cancellations made more than 24 hours before scheduled pickup: No charge.
• Cancellations made within 24 hours of scheduled pickup: A cancellation fee of up to 50% of the quoted price may apply.
• No-shows or refusal of goods at pickup: Full quoted amount may be charged.

5. Client Obligations

The Client agrees to:

• Provide accurate descriptions of goods, including weight, dimensions, and any hazardous properties.
• Ensure goods are properly packaged and labelled for transport.
• Comply with all applicable Australian laws and regulations regarding the goods being shipped.
• Provide safe and accessible pickup and delivery locations.
• Inform us of any special handling requirements prior to pickup.
• Not tender prohibited, illegal, or dangerous goods without prior written approval.

6. Liability and Insurance

Our liability for loss or damage to goods is limited in accordance with applicable Australian law and our carrier insurance terms:

• We carry standard carrier's liability insurance. Clients may request additional insurance coverage at an additional cost.
• Claims for loss or damage must be lodged in writing within 7 days of delivery (or expected delivery for lost goods).
• We are not liable for loss or damage caused by insufficient packaging, incorrect labelling, inherent vice of the goods, acts of God, or circumstances beyond our reasonable control.
• Our maximum liability shall not exceed the lesser of the market value of the goods or the limit specified in our insurance policy.

7. Payment Terms

• Payment terms are 14 days from the date of invoice unless otherwise agreed in writing.
• We accept payment by bank transfer, credit card, or other methods as agreed.
• Late payments may incur interest at a rate of 2% per month on the outstanding balance.
• We reserve the right to withhold delivery or release of goods until payment is received in full.
• We may exercise a general lien over goods in our possession for any outstanding amounts owed by the Client.

8. Warehousing Terms

For warehousing services:

• Storage fees are charged as specified in your service agreement (daily, weekly, or monthly rates).
• Goods stored for more than 90 days without communication may be deemed abandoned and disposed of in accordance with applicable law.
• The Client is responsible for ensuring stored goods are not perishable, hazardous, or illegal.
• We take reasonable steps to secure stored goods but are not liable for loss or damage beyond our standard insurance coverage.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, industrial action, road closures, extreme weather, or infrastructure failures.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of GURI Freight Pty Ltd or its licensors and is protected by Australian intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988.

12. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good faith negotiation. If a resolution cannot be reached within 30 days, the dispute may be referred to mediation in Victoria, Australia. These Terms are governed by the laws of the State of Victoria and the Commonwealth of Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

13. Limitation of Liability

To the fullest extent permitted by law, GURI Freight's total liability under these Terms shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. We exclude all implied warranties and conditions except those that cannot be excluded under the Australian Consumer Law.

14. Amendments

We reserve the right to amend these Terms at any time. Updated Terms will be posted on our website with a revised date. Continued use of our services after changes are posted constitutes acceptance of the amended Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
